Tenancy Databases and Fairness to Housing Tenants

In recent years Australia has seen the emergence of residential tenancy databases (such as TICA) that increase the ever-present power imbalances between tenants and lessors (and their agents) and often cause severe hardships for listed tenants. However, in the current political climate it is unlikely that tenancy databases will be statutorily prohibited. Accordingly, this paper explores options for legislative reform to regulate the operation of tenancy databases and identifies appropriate legal remedies available to tenants adversely affected by 'blacklists'.
