Jennifer Clark looks at the implications of the High Court's decisions in two native title cases, WA v Ward and Wilson v Anderson. Native title lawyers have been apprehensive that the High Court would resolve conflicts between the title discovered in 1992 and two centuries' worth of property law in a manner seriously disadvantageous to native title. Although the two cases tend to confirm the lawyers' pessimism, they also contain some surprises.
