Protecting privacy in New South Wales

10 June 2011The focus of this report is on the extent to which the current legislative regulation of privacy in NSW effectively protects individual privacy.

Its recommendations aim to simplify the law as well as remove inconsistency and ensure adequate coverage and enforcement of privacy legislation. The report deals with this from three perspectives:

  • First, it considers whether the scope of the legislation is effective both in reaching all public sector agencies in this State (chapter 2), and in protecting individuals in circumstances in which they consent, or appear to consent, to the use of their personal information in ways that may interfere with their privacy (chapter 3).
  • Secondly, it explores the question whether the many exemptions and exceptions that are found in privacy legislation effectively weaken its force or even render it ineffective (chapters 4-8).
  • Thirdly, it examines the effectiveness of the enforcement mechanisms available under the legislation (chapters 9-12).

In May 2011 the Federal Government announced that the Australian Charities and Not-for-profits Commission (ACNC) would commence operations from 1 July 2012 and that it would initially be responsible for determining the legal status of groups seeking charitable, public benevolent institution, and other not-for-profit (NFP) benefits on behalf of all Commonwealth agencies.
