This Privacy Victoria information sheet outlines the privacy rights of children under Victorian law.

Where the Information Privacy Act 2000 (‘the Act’), requires the consent of an individual to collect, disclose, transfer, access or correct their personal information, a parent or guardian can consent on their child’s behalf, but only where the child is incapable of understanding the general nature and effect of giving their consent.
