Improving and using the native title scheme: visions and dreams for the future

Native Title Australia

It is 15 years since the Native Title Act commenced to operate, and it is appropriate to take stock of what has been achieved to date, look at some of the challenges ahead and think creatively about how those challenges might be met so that the aspirations that were held for and remain embedded in the Act can be achieved in a timely, just and enduring fashion. This paper discusses how the native title claims process can be made more efficient and effective. It looks at the prospect of comprehensive settlements of claims, and looks beyond determinations of native title to next generation issues and using native title to advantage.
