Description

The AEC is preparing a pamphlet on the 2023 Referendum on whether to alter the Constitution to recognise the First Peoples of Australia by establishing an Aboriginal and Torres Strait Islander Voice. It will contain:

  • the case that is in favour of the proposed constitutional alteration,
  • the case that is against the proposed constitutional alteration,
  • a statement containing the proposed change to the Constitution, and
  • the AEC’s official guide to participating in the 2023 Referendum. 

The Yes and No cases were both submitted to the Electoral Commissioner by the required deadline of 11:59pm on Monday 17 July 2023. They have been provided for the public to view – unedited and unformatted. These versions of the Yes and No cases will be replaced with the official typeset version of the pamphlet when available. The typeset version will be used for printing the official pamphlet.

Each case had to consist of no more than 2,000 words. Each case also had to be authorised by a majority of the members of Parliament who voted for and against the proposed change to the Constitution respectively.

The Electoral Commissioner is satisfied that these conditions have been met for each of the cases. This paper outlines the case for a No vote.

The AEC was not involved in the development of the content in the Yes and No cases. The words in the Yes and No cases are as supplied by the respective parliamentary committees.
