Victoria’s system of criminal record checks needs legislative reform to meet the pressures of increasing demand and changing technologies, according to a new report by Paul Chadwick, Victorian Privacy Commissioner (OVPC). The report recommends that the Government develop a Controlled Disclosure of Criminal Records Bill to provide for the first time in Victoria a central, solid, precise statutory framework for the handling of criminal record data, a highly sensitive category of personal information. Three key principles should apply - avoidance of unjust discrimination, proportionality and clarity.
