This report presents a statistical profile of sentencing outcomes for occupational health and safety (OHS) offences sentenced in Victoria between 1 July 2005 and 30 June 2021. The purpose of the report is to provide an evidence base to consider reforms to the sentencing of OHS offences.

This consultation paper canvases potential reforms to improve the sentencing of occupational heath and safety (OHS) offences in Victoria. It poses 19 consultation questions to investigate issues such as the effectiveness and enforcement of sentences for OHS offences, and the involvement of victims and their families in sentencing proceedings.

This report presents a statistical profile of combined orders of imprisonment with a community correction order imposed in the Magistrates’ Court and higher courts of Victoria between 2012 and 2020.

This final report makes 26 recommendations for reforms to enhance the effectiveness of adjourned undertakings. These recommendations are the culmination of the Victorian Sentencing Advisory Council's extensive two-year review of adjourned undertakings and related orders in Victoria.

The Victorian Sentencing Advisory Council is seeking submissions on the questions posed in this consultation paper. The Council intends to use submissions, and the results of consultations, to make recommendations about the use of sentence deferral in Victoria.
