Description

The Royal Commission into Aged Care Quality and Safety (the Royal Commission) recommended that a completely new Aged Care Act be developed. This paper aims to guide consultation on the proposed foundations of a new Aged Care Act (the new Act), which is currently under development.

This paper complements existing consultation documents, which outline new policy initiatives that will be delivered via the new Act.

This paper covers:

  • the structure, purpose and constitutional foundation for the new Act,
  • the Statement of Rights,
  • the Statement of Principles,
  • the definition of high quality care,
  • a new duty of care and compensation pathways,
  • protections for whistleblowers,
  • supported decision-making arrangements, and
  • eligibility for funded aged care services.
