Immigration status is not recognised as a protected attribute under federal or state anti-discrimination law, with the Australian Capital Territory being the sole exception. Research shows that discrimination on the basis of immigration status is widespread. This brief analyses gaps in the current legal framework and sets out recommendations for reform.

From its inception in 1945, distinct national-interest features and values underpinned the social licence for Australia’s immigration program. This paper finds that public trust in government capacity or willingness to manage immigration in the national interest has eroded. It proposes a radical rethink of immigration, not reform around current settings, is now needed.

This policy brief provides practical policy solutions to improve the settlement and integration of migrants and refugees in Australia. Successful integration is a goal shared by newcomers, the communities they settle in and government at all levels and is critical to maintaining public support for immigration.
