A new digital competition regime
Proposal paper

Competition regulation

Description
This paper proposes a new regime that aims to promote competition in digital platform markets. It aims to address conduct that: is anti‑competitive, creates barriers to entry, and exploits market power to harm Australian users of digital platform services.
The proposed framework would introduce new, upfront requirements for certain digital platforms with a critical position in the Australian economy. These requirements would complement enforcement of existing competition law.
The paper seeks views on the proposal, focusing on:
- the framework and legislative approach – including in‑scope and priority services
- the designation process – to make sure the regime is targeted
- obligations for designated firms
- enforcement and compliance mechanisms.
Responses to this consultation can be submitted until 14 February 2025.
