Description
Misuse of market power is both a legal and economic concept. Prohibitions on the misuse of market power are commonly found in anti-trust laws in a number of countries and the prohibition appears as section 46 in Australia's Trade Practices Act 1974 (TPA). Using predatory pricing as an example, this Research Note argues that, since section 46 covers a variety of types of conduct, it may be better to deal separately and expressly with small business remedies by inserting a series of specific new sections in the TPA.
